ANA MARÍA RINCÓN

Ana María Rincón has more than seven years of experience advising clients on commercial and investment disputes in various sectors, including energy, mining, telecommunications, oil and gas, and infrastructure. He has extensive experience in arbitration proceedings conducted under the rules of ICSID and the ICC and administered by the Bogotá Chamber of Commerce. He has also advised clients in local Colombian arbitrations and litigation involving state-owned entities.

Before joining Rincón Castro Abogados, Ana María worked as a foreign associate at Arnold & Porter in Washington D.C. in the investment arbitration practice and at Covington & Burling in New York in construction arbitration. He also worked for more than four years in the litigation and arbitration team of Colombia’s largest law firm.

PROFESSIONAL EXPERIENCE

  • Represents two concessionaires of a 4G highway public-private partnership concession contract in an international arbitration under the International Centre for Dispute Resolution (ICDR) rules against the National Infrastructure Agency.

 

  • Represents a public entity in Colombia in an international arbitration against the contractor for the construction of a wastewater treatment plant in an international arbitration under the International Centre for Dispute Resolution (ICDR) rules.

 

  • Represents an autonomous patrimony attached to a public entity in Colombia that sponsors infrastructure projects in an international arbitration under the Rules of the Bogotá Chamber of Commerce against a foreign constructor to resolve disputes arising from the execution of contracts for the construction of educational institutions in Colombia.

 

  • Advises a design contractor specializing in infrastructure projects on contractual disputes.

 

  • Represented the Republic of Peru in defending an international investment arbitration initiated by Lupaka Gold Corp before the International Centre for Settlement of Investment Disputes (ICSID) under the Canada-Peru free trade agreement*.

 

  • Represented the Republic of Peru in defending an international investment arbitration initiated by Kaloti Metals & Logistics, LLC before the International Centre for Settlement of Investment Disputes (ICSID) under the U.S.- Peru free trade agreement*.

 

  • Represented a mine owner in Latin America in international arbitration under the ICDR rules in contractual disputes with the Contractor to exploit the mine*.

 

  • Represented Colombia’s most significant oil pipeline in a national arbitration to settle its contractual dispute with the granting entity to operate a port*.

 

  • Represented a gas transporter in a national arbitration involving disputes arising from a BOMT* contract.

 

  • Represented a company in the telecommunications sector in a national arbitration to settle its dispute with the State arising from a radio spectrum concession contract*.
